Domestic Violence

One of the most prevalent crimes in our entire society, and particularly in Utah, are domestic violence related crimes. Why? Because the laws in Utah are so skewed in favor of the police and prosecution that the domestic violence statute (the code that governs what the laws are), states that any act of unwanted physical contact by a co-habitant or relation by blood or marriage is domestic violence.

In practice, this means that gently brushing aside your husband or wife’s hand is domestic violence. Roommates engaged in an unwanted water fight is also domestic violence. If any children are present, regardless of whether they saw or heard anything, you may be charged with domestic violence in the presence of a child.

Recent Criminal Defense Victories

–Our client was facing several counts of assault and domestic violence in the presence of a child. The District Attorney’s Office was going forward without the victim, our client’s wife, and was making a technical argument that prior inconsistent statements of our client’s should be admitted. We did not believe the the DA’s Office understood the full meaning of this complex area of hearsay law and requested a hearing with the judge in which to argue against their position. The judge agreed with us that the statements were inadmissible, and the entire case against our client was dismissed.

–Our client was charged with a first degree felony drug distribution charge, carrying a penalty of life in prison. Through a deep investigation in which it was discovered that a confidential informant had made recordings of dealings with our client without her knowledge, we learned the basis of the government’s case. Our investigation also turned up that the informant was a drug addict that was informing on his friends in exchange for money from the police department. Discovering the weakness of the government’s main witness, something they did not wish to give us, we were able to negotiate a dismissal of our client’s case in exchange for a fine and drug classes.

–Our client was charged with several criminal charges, including theft, criminal mischief and disorderly conduct. Our client had given up hope of winning and told us she wanted to plead guilty, but we refused to let her. We had her perform a polygraph examination, which she passed, and used the results to have her case dismissed.

–Our client was charged with a first degree felony drug distribution charge and was potentially facing life in prison. Through a proper and thorough investigation in which it was revealed a co-defendant may have been responsible for the actual distribution, his charge was reduced to a misdemeanor and he received a fine and probation with drug classes.
